Garibian Law Offices has filed a class action lawsuit in federal Court in Delaware to enforce consumers’ rights under federal law, which prohibits unauthorized credit inquiries. As the lawsuit states, when companies fail to obtain a consumer’s authorization or do not have a permissible purpose, they are not permitted to access or make an inquiry on a consumer’s credit report.
Multiple Violations of Federal and State Law Cited in the Lawsuit
Garibian Law Offices filed suit on behalf of its client, asserting several violations of the Fair Credit Reporting Act (FCRA), which governs the activities of lenders and creditors in how they handle consumer information. Under the FCRA, a consumer credit report can only be obtained with an individual’s written authorization or for clearly defined permissible purposes.
